Introduction

Welcome to Mill Decking. By visiting our website, requesting an estimate, or entering into a project agreement with us, you agree to be bound by the following terms and conditions. Please read them carefully before proceeding. If you have questions about any section, contact us directly at contact@milldecking.com or (425) 600-2051 before engaging our services.

These terms apply to all clients, visitors, and parties who interact with Mill Decking in any capacity, including residential deck construction, resurfacing, covered structures, railing replacement, waterproofing, siding, window replacement, paver installation, and fencing.

1. Services Provided

Mill Decking provides residential and commercial exterior construction services in Washington state, including but not limited to:

  • Deck building and new construction

  • Deck resurfacing and board replacement

  • Covered deck and roof structure installation

  • Railing replacement (wood, aluminum, and metal)

  • Waterproofing systems and under-deck membrane installation

  • Siding installation and replacement

  • Window replacement

  • Paver and hardscape installation

  • Fence installation

The specific scope of work, materials, timeline, and total project cost for each engagement will be outlined in a written estimate or project agreement. No work will begin until both parties have reviewed and agreed to the documented scope in writing.

2. Estimates and Quotes

All estimates provided by Mill Decking are based on information available at the time of the site visit and are valid for 30 days from the date of issue unless otherwise stated in writing.

  • Estimates are provided at no cost and with no obligation to proceed

  • Final pricing is confirmed in the written project agreement

  • Estimates may be revised if site conditions, material availability, or project scope change materially between the estimate date and project start

  • Mill Decking will communicate any anticipated pricing changes in writing before proceeding with affected work

3. Project Agreements and Deposits

A signed project agreement is required before any work begins. The project agreement will specify:

  • Full scope of work

  • Materials to be used

  • Total project price

  • Payment schedule

  • Estimated start and completion dates

Deposits: A deposit is required to secure your project start date. The deposit amount will be specified in your project agreement, typically ranging from 25% to 50% of the total project cost depending on project size and material procurement requirements.

  • Deposits are non-refundable once materials have been ordered or scheduled

  • If a project is cancelled before materials are ordered, Mill Decking will review refund eligibility on a case-by-case basis

  • The remaining balance is due upon project completion and final walkthrough

4. Client Responsibilities

To ensure your project proceeds on schedule and without disruption, the client agrees to:

  • Provide clear and safe access to the project site throughout the build

  • Disclose any known property conditions that may affect the build, including underground utilities, buried structures, property line disputes, or HOA restrictions

  • Obtain any required HOA approvals or third-party permissions before the project start date

  • Respond promptly to requests for decisions, material selections, or approvals — delays caused by client decisions may affect the project timeline

  • Ensure the property is free of conditions that would prevent permit approval or municipality inspection

  • Notify Mill Decking immediately of any concerns observed during the build

5. Permits and Code Compliance

Mill Decking manages the permit application and submission process as a standard part of every applicable project. This includes:

  • Preparation of required construction drawings and site plans

  • Submission of permit applications to the relevant municipality

  • Communication with local building departments and inspectors

  • Scheduling and facilitating required inspections

Client responsibilities related to permits:

  • The client is responsible for ensuring the property is free of liens, title disputes, or restrictions that may prevent permit approval

  • HOA approvals, if required, are the responsibility of the client to obtain before the permit application is submitted

  • Any permit fees paid by Mill Decking on the client's behalf will be included in the project agreement and billed accordingly

All Mill Decking work is performed in compliance with current Washington state building codes and local municipality requirements. Mill Decking does not perform work intended to circumvent or avoid permit requirements.

6. Materials

Mill Decking sources materials from established suppliers and manufacturers. The materials specified in your project agreement represent the agreed-upon specification for your build.

  • Material substitutions will only occur if a specified product becomes unavailable between the estimate date and project start, in which case Mill Decking will notify the client and propose a comparable alternative

  • Mill Decking does not accept client-supplied materials unless explicitly agreed to in writing before the project start

  • All materials installed by Mill Decking are chosen for suitability in Pacific Northwest climate conditions

  • Material warranties are provided by the respective manufacturers and are passed through to the client upon project completion

7. Workmanship Warranty

Mill Decking warrants all labor and workmanship on completed projects as follows:

  • Structural workmanship: 2 years from the date of project completion

  • Surface and finish workmanship: 1 year from the date of project completion

  • Warranty claims must be submitted in writing to info@milldecking.com within the applicable warranty period

  • Mill Decking will inspect warranted claims within 10 business days of receipt and propose a resolution within 30 days

Warranty exclusions — the following are not covered under the Mill Decking workmanship warranty:

  • Damage caused by weather events, natural disasters, or acts of God

  • Damage resulting from improper use, abuse, or neglect by the client or third parties

  • Modifications made to the completed work by the client or any party other than Mill Decking after project completion

  • Pre-existing structural or site conditions discovered after project completion that were not accessible or visible during the build

  • Normal weathering, aging, or color change of natural wood materials

  • Damage caused by failure to perform manufacturer-recommended maintenance on natural wood materials

8. Changes to Project Scope

Any changes to the agreed project scope after work has begun must be documented in a written change order signed by both parties before the additional work proceeds. Change orders may affect

  • Total project price

  • Project timeline and completion date

  • Permit scope or municipality requirements

Mill Decking will not proceed with scope changes based on verbal instructions alone. Written change order documentation protects both parties and ensures the project record remains accurate.

9. Project Timeline

Estimated project timelines are provided in good faith based on typical conditions for the scope of work involved. Mill Decking will communicate the expected timeline in the project agreement and provide updates if conditions change.

Timeline adjustments may occur due to:

  • Weather conditions that make outdoor construction unsafe or impractical

  • Material delivery delays beyond Mill Decking's control

  • Permit processing delays by the relevant municipality

  • Unforeseen site conditions discovered during the build

  • Client-requested changes to scope or schedule

Mill Decking will notify the client as early as possible of any anticipated timeline changes and provide a revised completion estimate.

10. Site Conditions and Unforeseen Work

Mill Decking performs a site assessment before providing an estimate. However, some conditions are not visible or accessible until work begins. If unforeseen conditions are discovered during the build — including but not limited to hidden rot, structural deficiencies, inadequate existing framing, or subsurface obstructions — Mill Decking will:

  • Stop affected work immediately upon discovery

  • Notify the client of the condition and its implications

  • Provide a written change order documenting the additional scope and cost required to address it

  • Resume affected work only after the client has approved the change order in writing

Mill Decking will not perform work that knowingly covers or conceals structural deficiencies without the client's written acknowledgment.

11. Payment Terms

Payment terms are specified in your project agreement. Standard payment structure is as follows:

  • Deposit: Due upon signing the project agreement — required to secure materials and schedule

  • Progress payment: May be required on larger projects — specified in the project agreement if applicable

  • Final payment: Due upon project completion and final walkthrough

Late payments:

  • Invoices not paid within 10 days of the due date may incur a late fee of 1.5% per month on the outstanding balance

  • Mill Decking reserves the right to place a lien on the property in accordance with Washington state lien law for unpaid balances on completed work

  • Active projects may be paused if a scheduled payment is more than 10 days overdue

Accepted payment methods will be specified in the project agreement.

12. Liability Limitations

Mill Decking is fully licensed and insured for residential and commercial exterior construction work in Washington state. However, Mill Decking's liability is limited as follows:

  • Mill Decking is not liable for pre-existing property conditions, including structural deficiencies, soil conditions, or drainage issues that were present before the project began

  • Mill Decking is not liable for delays, damages, or additional costs arising from circumstances outside of our control, including weather events, permit processing delays, material shortages, or third-party actions

  • Mill Decking's total liability for any claim arising from a project shall not exceed the total amount paid by the client for that specific project

  • Mill Decking is not liable for consequential or indirect damages, including lost use of property, rental costs, or business income losses

Nothing in this section limits Mill Decking's liability for gross negligence, willful misconduct, or violations of Washington state contractor licensing requirements.

13. Dispute Resolution

Mill Decking is committed to resolving any disputes directly and in good faith. If a dispute arises from a project or these terms:

  1. The client should contact Mill Decking in writing at info@milldecking.com describing the concern

  2. Mill Decking will respond within 10 business days with a proposed resolution

  3. If the dispute cannot be resolved informally, both parties agree to participate in mediation before pursuing any formal legal action

  4. Any legal proceedings arising from a Mill Decking project or these terms shall be governed by Washington state law and conducted in King County, Washington

14. Intellectual Property

All project designs, drawings, plans, and documentation prepared by Mill Decking remain the intellectual property of Mill Decking until full payment has been received. Upon final payment, the client receives a license to use the completed designs and documentation for the purposes of the completed project only.

15. Photography and Portfolio Use

Mill Decking may photograph completed projects for use in our portfolio, website, and marketing materials. If you prefer that your project not be photographed or featured, please notify us in writing before the project start date. We respect all client preferences regarding photography and will honor opt-out requests without exception.

16. Governing Law

These terms and conditions are governed by the laws of the State of Washington. Any disputes arising under these terms shall be resolved under Washington state law in the appropriate courts of King County, Washington.

17. Updates to These Terms

Mill Decking reserves the right to update these terms and conditions at any time. Updated terms will be posted to milldecking.com with a revised effective date. Continued engagement with Mill Decking's services following a posted update constitutes acceptance of the revised terms.
